Copyright Policies

All members of the Tooba University community are required to comply with copyright laws. Federal copyright laws provide valuable protection to the authors of original works, and Tooba University expects all members of the university to respect those rights. 

Copyright laws also permit users of copyrighted works to make “fair use” of copyrighted materials under some limited circumstances (see below). Tooba University is committed to full support of the fair use of copyrighted works by the Tooba University community under the provisions of applicable laws. 

Failure to comply with copyright laws and to act in good faith in the fair use of copyrighted material will result in a Tooba University community member assuming liability for his or her actions and may result in disciplinary action.

Fair Use of Copyrighted Material

A proper determination of fair use–in daily practice and in the courts–requires applying these four factors to the specific circumstances of the use:  Purpose or character of the use; Nature of the copyrighted work being used; Amount and substantiality of the work being used; Effect of the use on the market for or value of the original.

These factors must be evaluated to determine whether most of them weigh in favor of or against fair use. Nonprofit educational purposes are generally favored in the application of the four factors of fair use, but an educational use does not by itself make the use a “fair use.” One must always consider and weigh all four factors of fair use together. 

Intellectual Property 

Tooba University (Al-Huda Inc) shall own all and exclusive rights, title, and interest in any creative educational product made by instructors, content developers, or course designers, and these rights are applicable throughout the world. Creative educational products include course descriptions, syllabi, outlines, articles, lesson plans, chapters in books, slide presentations, videos, drawings, or identifiers including copyrights, domain names, trademarks, and all other intellectual and creative property rights in the work. The work shall be deemed to be a work-for-hire under the Copyright Act of 1976, Title 17 U.S.Code, and Tooba University (Al-Huda, Inc) shall be deemed to be the author.
